Why would I declare a Chapter 13 Bankruptcy?
  • A Chapter 13 Bankruptcy will allow you to stop foreclosure and save your home.
  • A Chapter 13 Bankruptcy will allow you to stop an eviction and assume a lease.
  • A Chapter 13 Bankruptcy allows you to save a vehicle that is in default or even repossesed.
  • A Chapter 13 Bankruptcy allows you to get back your drivers' license if the only reason for suspension is motor vehicle surcharges.
Why would I declare a Chapter 7 Bankruptcy?
  • A Chapter 7 Bankruptcy will allow you to get creditors off your back and get you a fresh start.
  • A Chapter 7 Bankruptcy will stop a phone company or electric company from shutting you off and allow you to get the utility turned back on if it was shut off.
  • A Chapter 7 Bankruptcy allows you to get your driver's license back if a judgment has been entered against you.
  • A Chapter 7 Bankruptcy allows you to stop a bank levy or wage garnishment immediately.

Please note with the new law going into effect October 17th 2005, there may be circumstances where bankruptcy may not automatically protect your property. You must specifically discuss the facts of your individual case to make sure that you are protected under the changes in the new law. Since there is no interpertation of the law, I must analyze everything from a case by case basis.
