First you should never file bankruptcy pro se (without an attorney). There are so many technicalities and traps that create land mines for experienced bankruptcy practitioners. Thus, filing yourself can create severe problems that cannot be rehabilitated. If you make a mistake it can result in loss of property.
An example is as follows why a pro se filing can be disastrous: A client came into Mr. Taieb’s office with foreclosure papers and stated he wanted to save his home. When asked if he had ever filed bankruptcy he said no. Lo and behold after pulling his credit report, TAIEBLAW learned he had 2 cases dismissed within the last years, which would not create a stay if he filed right now. These are the types of situations that can result when you are not familiar with the law.
Even though this happened with the potential client filing pro se, it can also happen when you use a dabbler, and attorney who handles every type of case but specialized in nothing. You want someone who only specializes in bankruptcy law and is familiar with the Judges, trustees and all the creditors’ attorneys.
